Yes! Well, mostly. Fireworks are awesome (you don’t have to tell us twice!) but they come with a whole bunch of rules and regulations. That’s why we’ve broken down the laws for you to keep you safe, having fun, and compliant when purchasing fireworks online.
WHERE ARE FIREWORKS LEGAL IN GEORGIA?
Pretty much everywhere! Georgia allows the legal use of all consumer fireworks across its counties, although there are some specific restrictions. Fireworks may never be set off on:
- Public roads
- Highways
- Railroads
- Public-access streets
Or within 100 yards of:
- Electrical plants
- Gas stations
- Refineries
- Jails or prisons
- Hospitals
- Helipads
- Nursing homes
- Healthcare facilities
- Waste-water treatment plants
- Water treatment plants
While you can use them in city parks or on city property, you’ll need a permit to do so.
Note: If you live in a Homeowners Association, the rules might be different. Florida law states that the designated holidays don’t supersede existing neighborhood restrictions or government ordinances locally, so make sure you check with our HOA before lighting up.
WHEN ARE FIREWORKS LEGAL IN GEORGIA?
Again, good news: all consumer fireworks are legal! The only specifically prohibited fireworks are balloons, bags, parachutes, or similar products which require fire underneath for propulsion, or products like floating water lanterns.
You must be 18 or older to legally purchase fireworks in Georgia.
WHEN ARE FIREWORKS LEGAL IN GEORGIA?
Consumer fireworks may be used between 10am-11:59pm on any date, unless doing so would violate the local noise ordinance.
(Note: The noise ordinance must have been approved or adopted on or after July 1, 2018. Some cities’ ordinances, such as Alpharetta, don’t need this qualification, so check with your town or city hall to be safe.)
However, all cities and towns can use fireworks on certain days until 11:59pm, even if their local noise ordinance generally prohibits it:
- New Year’s Eve (December 31 with an extension until 1am on January 1)
- Independence Day (July 3 and 4)
- Memorial Day (this one is a little confusing—you can use fireworks the last Saturday and Sunday in May, but cannot use them the Monday of Memorial Day itself)
- Labor Day (the first Monday in September)
Outside of major holidays, Georgians will be happy to know that consumer-grade fireworks are now allowed to be used every day so long as they do not violate the local noise ordinance.
Fireworks are subject to a 5% tax in Georgia. This money goes to the Georgia Trauma Care Network Commission and the Georgia Firefighter Standards and Training Council. It also goes to public safety efforts in the local government.
