Sort of! Florida allows the purchase and use of fireworks, but you have to use the right fireworks at the right time—and we know it can get confusing. That’s why we’ve broken down the laws for you to keep you safe, having fun, and compliant when purchasing fireworks online.
WHAT FIREWORKS ARE LEGAL IN FLORIDA?
Florida has a number of novelty fireworks that are legal for use and purchase all year long, including:
- Sparklers (see the Approved Sparkler List for more information!)
- Toy pistols, guns, and canes
- Snakes/glow worms
- Trick noisemakers (like snappers and poppers)
With the exception of three holidays (see below), it’s illegal to use combustible or explosive fireworks that are prepared for visible and audible effects including deflagration, explosion, detonation and combustion, including:
- Blank cartridges and toy cannons in which explosives would be used
- Balloons requiring fire for propulsion, such as sky lanterns
- Firecrackers
- Skyrockets
- Roman candles
- Torpedoes
- Dago bombs
- Fireworks containing flammable tablets or compounds/explosive substances

Note: If you live in a Homeowners Association, the rules might be different. Florida law states that the designated holidays don’t supersede existing neighborhood restrictions or government ordinances locally, so make sure you check with our HOA before lighting up.
WHEN ARE FIREWORKS LEGAL IN FLORIDA?
Told you we’d clarify! Consumer fireworks are only legal in Florida three days a year:
- Independence Day (July 4)
- New Year's Eve (December 31)
- New Year's Day (January 1)
You must be 18 or older to legally purchase fireworks in Florida.
